Two bodies of Texas law govern collateral lending depending on structure. Texas Finance Code Chapter 371 covers pawnbroker transactions; under § 371.006, a pawnbroker is a person who lends money on the security of pledged goods — meaning the lender takes physical possession. Under § 371.051, operating as a pawnbroker requires a state licence. The service-charge caps in § 371.159 are tiered: up to 20% per month for loans at or below $270; up to 15% per month for $270.01–$1,800; up to 2.5% per month for $1,800.01–$2,700; and up to 1% per month — equivalent to 12% APR — for loans between $2,700.01 and $18,500.
